HEARING NOTICE
INCORPORATED VILLAGE OF BAYVILLE
ZONING BOARD OF APPEALS

PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Incorporated Village of Bayville will hold a Public Hearing at the Village Hall, 34 School Street, Bayville, Nassau County, New York, on Wednesday, October 25, 2017 at 7:30 p.m. to consider the following:

#Z-12-17, Powers Residence (5d Arch& Eng)
Application for an alteration with a second floor addition requiring the following variances:
Chapter 80, Article V, Section 80-20, Lot Requirements
No building shall be erected on any lot that has less than:
A(1) 75 ft. of frontage; the existing frontage is 65 ft.
A(2) 75 ft. of lot width from the front property line to a depth of 40 ft.; the existing lot width is 65 ft.
A(3) 7500 sq. ft. of lot area; the existing lot area is 6110 sq. ft.
Chapter 80, Article V, Section 80-21, Yard Requirements
There shall be front, rear and side yards on each plot of not less than the following:
A(3) Side yard not less than 8 ft., provided the sum of the two side yards is not less than 20 ft.; the existing side yards are 7 ft. and 6.1 ft.
Chapter 80, Article V, Section 80-22, Bulk Regulations
(B) Lot coverage: the building area shall not exceed 25%; the proposed lot coverage is 1983 sq. ft, where the maximum permitted is 1528 sq. ft. (C) Floor Area Ratio: the FAR shall not exceed 0.40 or 2444 sq. ft; the proposed FAR is 3058 sq. ft.
Chapter 80, Article XII, Section 80-60, Supplementary Area and Height
(G) Only one shed is permitted per property and shall be located at least 3 ft. from any lot line; there are two existing sheds on the rear property line.
Chapter 80, Article XVI, Section 80-82, Alterations
Any alteration to a nonconforming use, building or structure that would change the building front, side or rear yards, must submit an application to the Zoning Board of Appeals.

This property is known on the Land and Tax Maps of Nassau County as Section 29, Block G, Lot 630 in the Residential C District. It is also known as 27 Madison Avenue, Bayville, NY.

#Z-16-17, Finn Residence (Bruscella Arch)
The building application for the property was denied pursuant to the following sections of the Village Code:
§80-22 A Height restrictions. No building erected in the Residence C District shall exceed 2 ½ stories, or 28 feet in height measured from the average ground level at the perimeter of such building. The proposed height is 30 ft., 6 inches.
§80-22 B The building lot coverage shall not exceed 25% of the first 7500 square feet and 12.5% of the area greater than 7500 or 2210 square feet. The proposed lot coverage is 2635 square feet at 26%.
In addition to the area variances, the applicant is applying for two-family use, which was permitted as pre-existing, non-conforming in the existing residence. However once the building is demolished, the two-family occupancy will be discontinued.
§80-88 A.(4)(e) No variance may be granted to permit: Any use which is not permitted in any district in the Village of Bayville. Two-family occupancy is not permitted in any zoning district in the Village of Bayville (as per Section 80-19A and Section 80-13 A-C.)

#Z-17-17, Megerian Residence, (Bruscella, Arch)
The building application for the property was denied pursuant to the following sections of the Village Code:
§80-82 Alteration to a pre-existing non-conforming use.
§80-15 A Front Yards. Where, at the time of the passage of this chapter, at least half of the buildings situated on either side of a street between two intersecting streets conform to a minimum setback line, no new building shall be erected and no existing building shall be reconstructed or altered to project beyond such a setback line. The foregoing rule shall, however, in no case be applied so as to keep the street wall or walls of buildings more than 25 feet from the street line. Where there is no existing building in the block, no new building shall be erected with its street wall nearer than 20 feet to the street line. The existing front yard is 20 feet 11 inches.
§80-16 B Lot Coverage. The building area shall not exceed 25% of the first 5000 square feet of lot area, and 12.5% of that portion of the lot area, if any, in excess of 5000 square feet.
Based on lot size of 5397 square feet, the allowable coverage is:
5000 x 25% = 1250 feet. 396.5 x 12.5% = 49.56 square feet.
Total = 1299.56 square feet. The proposed lot coverage is 1997 square feet.

§80-16 C The floor area ratio shall not exceed 0.45, or 2429 square feet.
The proposed FAR is 2808 square feet or 0.52.

§80-18 A Each detached garage, accessory building and structure, unless expressly provided to the contrary elsewhere in this chapter, shall be located at least three feet from the rear property line and each side property line, and at least five feet from the primary building on the lot.
The existing setbacks are 2 feet, 5 inches and 2 feet, 6 inches.
§80-18 C No detached garage shall occupy more than 500 square feet of lot area. The existing garage has 531 square feet.

This property is known on the Land and Tax Maps of Nassau County as Section 29, Block D, Lot 750 in the Residential B District. It is also known as 11 Tildean Lane, Bayville, NY.
