HEARING NOTICE
INCORPORATED VILLAGE OF BAYVILLE
ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Incorporated Village of Bayville will hold a Public Hearing at the Village Hall, 34 School Street, Bayville, Nassau County, New York, on Wednesday, January 31, 2018 at 7:30 p.m. to consider the following:

The building permit application to construct a covered front porch and steps to grade at the above-reference property is hereby denied, pursuant to the following sections of the Village Code:
§80-20 Lot Requirements: No building or structure shall be erected on any lot within the C District that has less than:
A(1) 75 feet of street frontage.
The required minimum street frontage is 75 feet and the existing is 50 feet.
A(3) 7500 square feet of lot area.
The required minimum lot area is 7500 sq. feet and the existing is 4750 sq. ft.
§80-21 Yard Requirements: There shall be front, rear and side yards on each plot of not less than the following depth or width:
A(1) Front Yard: 25 feet.
The minimum front yard setback is 25 feet and the proposed is 24.3 feet.
A(3) Side Yard: eight feet, provided the sum of the two side yards shall not be less than 20 feet.
The proposed side yards are 5.8 feet and 12.7 feet.
§80-22 Bulk Regulations: The building lot coverage shall not exceed 25% of the first 7500 square feet and 12.5% of any additional area in excess of 7500 sq. feet.
B Lot Coverage: The existing building area is 1530 sq. feet; the proposed building area is 1731 sq. feet, or 36.42%.
§80-82 Alterations: Any alteration to a nonconforming use, building or structure that would change the building’s or structure’s front setback, side yard or rear yard, shall not be permitted unless an application for variance is made to the Board of Appeals.
This property is known on the Land and Tax Maps of Nassau County as Section 29, Block 26, Lot 87 in the Residential C District. It is also known as 23 Adams Avenue, Bayville, NY.
