ZONING BOARD OF APPEALS

PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Incorporated Village of Bayville will hold a Public Hearing at the Village Hall, 34 School Street, Bayville, Nassau County, New York, on      Wednesday, January 25, 2017 at 7:30 p.m. to consider the following application:

#Z-1-17, McBride Residence

Applicant wishes to construct a two-story addition requiring the following variances:

Chapter 80, Article XVI, Section 80-82 Alternations

Any alteration to a nonconforming use, building or structure that would change the building’s front yard, side or rear yard shall not be permitted unless an application for variance is made to the Board of Appeals.

Chapter 80, Article VIII, Section 80-40 (A) Height Restrictions

No building shall exceed 2 ½ stories, or 28 feet in height measured from the average ground level; the addition height is 28 feet, with a cupola measuring 4.6 feet, for a total height proposed at 32.6 feet.

Chapter 80, Article XIII, Section 80-60 (G) Supplementary Area Provisions

A utility shed may be erected in a rear yard, provided such shed does not exceed 120 s/f of floor area and 9 feet in height; the existing shed is located in a front yard with a floor area of 244.7 s/f.

#Z-2-17, J. Bruscella, Arch (Pane Residence)

Applicant wishes to construct a second-story addition, requiring the following variances:

Chapter 80, Article XVI, Section 80-82 Alternations

Any alteration to a nonconforming use, building or structure that would change the building’s front yard, side or rear yard shall not be permitted unless an application for variance is made to the Board of Appeals.

Chapter 80, Article V, Section 80-20 (A3) Lot Requirements

No building shall be erected on any lot with less than 7500 s/f of lot area; the lot has 4700 s/f of lot area.

Chapter 80, Article V, Section 80-21 (B) Yard Requirements

On corner plots, a front yard of at least 25 feet shall be required on each street; the existing north side porch setback is – 0.4 feet and proposed second story setback to be 9 feet.  The existing east side patio setback is 3.6 feet and proposed second story setback to be 10.33 feet.

Chapter 80, Article V, Section 80-22 (C) Bulk Restrictions

The Floor Area Ratio (FAR) shall not exceed 0.40; the proposed FAR to be 0.46.

#Z-3-17,  Nielsen & Shoemaker, Arch (Tsoumpas Residence)

Applicant wishes to construct a second-story addition that requires the following variances:

Chapter 80, Article XVI, Section 80-82 Alternations

Any alteration to a nonconforming use, building or structure that would change the building’s front yard, side or rear yard shall not be permitted unless an application for variance is made to the Board of Appeals.

Chapter 80, Article V, Section 80-21 (A1) Front Yard Requirements

There shall be a front yard on each plot of not less than 25 feet; the proposed front yard setback is 9.7 feet.

Chapter 80, Article V, Section 80-21 (A2) Rear Yard Requirements

There shall be a rear yard on each plot of not less than 25 feet; the proposed rear yard setback is 9.7 feet.

Chapter 80, Article V, Section 80-22 (A) Height Restrictions

No building erected in the Residence C District shall exceed 2 ½ stories or 28 feet measured from the average ground level at the perimeter of such building; the proposed height is 29 feet.

Chapter 80, Article V, Section 80-22 (B) Lot Coverage

The building area shall not exceed 25% or 1625 s/f of lot area; the proposed lot coverage is 1719 s/f.

This property is known on the Land and Tax Maps of Nassau County is Section 29, Block 5, Lots 78, 79, 80 in the Residential C District.  It is also known as 19 Cyrus Point Lane, Bayville, NY.
