HEARING NOTICE
INCORPORATED VILLAGE OF BAYVILLE
ZONING BOARD OF APPEALS

PLEASE TAKE NOTICE that the Zoning Board of Appeals of the Incorporated Village of Bayville will hold a Public Hearing at the Village Hall, 34 School Street, Bayville, Nassau County, New York, on Wednesday, August 30, 2017 at 7:30 p.m. to consider the following application:

#Z-10-17, Zaager Residence (Kahn, Arch)
Application to construct a second floor addition requiring the following variances:

Chapter 80, Article V, Section 80-20, Lot Requirements
No building shall be erected on any lot that has less than:
A(1) 75 ft. of frontage; the existing frontage is 25.09 ft.
A(2) 75 ft. of lot width from the front property line to a depth of 40 ft.; the existing lot width is 25 ft.
A(3) 7500 sq. ft. of lot area; the existing lot area is 1149 sq. ft.

Chapter 80, Article V, Section 80-21, Yard Requirements
There shall be front, rear and side yards on each plot of not less than the following:
A(1) Front yard not less than 25 ft.; the existing is 6.36 ft. and the proposed is 15 ft. A(2) Rear yard not less than 25 ft.; the existing is 3.19 ft. and the proposed is 10 ft.
A(3) Side yard not less than 8 ft., provided the sum of the two side yards is not less than 20 ft.; the existing side yards are 1 ft. and 0.6 ft.

Chapter 80, Article V, Section 80-22, Bulk Regulations
(B) Lot coverage: the building area shall not exceed 25%; the proposed lot coverage is 800 sq. ft, where the maximum permitted is 287 sq. ft.
(C) Floor Area Ratio: the FAR shall not exceed 0.40; the proposed FAR is 105%

Chapter 80, Article XVI, Section 80-82, Alterations
Any alteration to a nonconforming use, building or structure that would change the building front, side or rear yards, must submit an application to the Zoning Board of Appeals.

This property is known on the Land and Tax Maps of Nassau County as Section 28, Block 17, Lot 111 in the Residential C District. It is also known as 425 Bayville Avenue, Bayville, NY.

#Z-11-17, Barricelli Residence (aka Family Beach House, LLC; Art of Form, Arch)
Application to alter an existing single family home and construct a second floor addition requiring the following variances:

Chapter 80, Article V, Section 80-20, Lot Requirements
No building shall be erected on any lot that has less than:
A(1) 75 ft. of frontage; the existing frontage is 40 ft.
A(2) 75 ft. of lot width from the front property line to a depth of 40 ft.; the existing lot width is 40 ft.
A(3) 7500 sq. ft. of lot area; the existing lot area is 3887 sq. ft.

Chapter 80, Article V, Section 80-21, Yard Requirements
There shall be front, rear and side yards on each plot of not less than the following:
A(1) Front yard not less than 25 ft.; the existing is 23.75 ft., the proposed is 17.23 ft.
A(2) Rear yard not less than 25 ft.; the existing is 26.8 ft., the proposed is 22.75 ft.
A(3) Side yard not less than 8 ft., provided the sum of the two side yards is not less than 20 ft.; the existing side yards are 3.85 ft. and 7.08 ft.

Chapter 80, Article V, Section 80-22, Bulk Regulations
(B) Lot coverage: the building area shall not exceed 25%; the proposed lot coverage is 42.8% or 1667 sq. ft., where the maximum permitted is 971 sq. ft.
(C) Floor Area Ratio: the FAR shall not exceed 0.40; the proposed FAR is 0.78.

Chapter 80, Article XVI, Section 80-82, Alterations
Any alteration to a nonconforming use, building or structure that would change the building front, side or rear yards, must submit an application to the Zoning Board of Appeals.
